What is generative AI and how does it affect copyright?

Generative AI is a type of artificial intelligence technology that produces an output such as text or an image in response to user instructions (prompts) based on the datasets it is trained with. Both these datasets and the final output obtained through the AI tool may present issues related to the infringement of copyright or other Intellectual Property rights. 

If you wish to create a trademark or own the copyright for your design, we recommend that you do not allow designers to use generative AI in your contest. Additionally, please note that AI-generated content is not considered to be the work of a human creator, meaning it fails to meet the legal requirements for copyright protection in many jurisdictions. 

99designs views AI-generated content as third-party material, and as such it is not allowed in any logo, illustration or button and icon design contests. 

If you do choose to allow the use of generative AI in your contest in any other category, designers will declare if and how they used AI tools in their design when they submit a concept. In a 1-to-1 projects your designer will inform you about any AI tools they used in a message via the activity tab. It is important that you carefully review the terms and conditions of the tool used by your designer to ensure you are able to use the design in the way you want, particularly for commercial purposes.
